Agreement to Terms
Welcome to TrailSync! These Terms of Service ("Terms") govern your access to and use of the TrailSync mobile application and website (collectively, the "Service"). By accessing or using TrailSync, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Service.
Eligibility
You must be at least 13 years old to use TrailSync (or 16 years old if you reside in the European Economic Area). By using the Service, you represent and warrant that you meet this age requirement.
If you are under 18, you must have permission from a parent or guardian to use the Service.
Account Registration
To use TrailSync, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You May:
- Use TrailSync to plan and coordinate hiking and backpacking trips
- Invite other users to collaborate on trips
- Create, modify, and share trip-related content
- Access features available to your account type
You May NOT:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Harass, abuse, or harm other users
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to the Service or other users' accounts
- Scrape, copy, or reverse engineer the Service
- Use automated tools (bots, scrapers) to access the Service
- Impersonate any person or entity
- Collect or harvest personal information about other users
- Interfere with or disrupt the Service or servers
- Use the Service for commercial purposes without authorization
User Content
Your Content
You retain ownership of all content you create, upload, or share through TrailSync ("User Content"), including trip details, routes, gear lists, messages, photos, and other data.
By using the Service, you grant TrailSync a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of operating and improving the Service.
Content Responsibility
You are solely responsible for your User Content and the consequences of sharing it. You represent and warrant that:
- You own or have the necessary rights to your User Content
- Your User Content does not violate any third-party rights
- Your User Content complies with these Terms and applicable laws
Prohibited Content
You may not upload or share content that:
- Is illegal, harmful, threatening, abusive, or discriminatory
- Infringes on intellectual property rights
- Contains personal information of others without consent
- Is spam, advertising, or unsolicited promotional material
- Contains malware or malicious code
Trip Collaboration and Sharing
When you invite participants to a trip, you agree that:
- Invited participants can view and contribute to trip information
- Your profile information may be visible to trip participants
- You are responsible for managing trip access and permissions
- Removing yourself from a trip may affect other participants' access to your contributions
Beta Testing Program
If you participate in our TestFlight beta program, you acknowledge that:
- Beta software may be unstable, incomplete, or contain bugs
- Features may change or be removed before public release
- You may experience data loss or service interruptions
- Apple may collect usage data and crash reports through TestFlight
- Your feedback helps us improve the app
- Beta access may be revoked at any time
Important: Do not rely on beta versions for critical trip planning. Always have backup plans and offline maps.
Safety and Liability
Outdoor Activities Disclaimer
TrailSync is a planning and coordination tool. We do not provide hiking, navigation, or safety services. You are solely responsible for:
- Assessing your fitness level and capabilities
- Planning safe and appropriate routes
- Bringing necessary safety equipment
- Checking weather conditions and trail status
- Obtaining required permits and permissions
- Following Leave No Trace principles
- Knowing your limits and turning back when necessary
No Warranty on Data Accuracy
While we strive for accuracy, we do not guarantee that:
- Route data, elevation profiles, or distances are accurate
- Weather forecasts are current or reliable
- Maps reflect current trail conditions
- Third-party data sources are up-to-date
Always verify information with official sources and carry physical maps and compass.
Emergency Services
TrailSync is NOT an emergency service. In case of emergency:
- Call 911 or local emergency services immediately
- Use satellite communication devices in remote areas
- Carry personal locator beacons (PLBs) when appropriate
Intellectual Property
TrailSync Property
The Service, including its design, features, functionality, code, graphics, and logos, is owned by TrailSync and protected by copyright, trademark, and other intellectual property laws.
Third-Party Services
TrailSync uses third-party services that have their own terms and licenses:
- Mapbox maps and routing data
- OpenStreetMap geographic data
- OpenWeatherMap weather forecasts
Your use of these services through TrailSync is subject to their respective terms.
Fees and Payment
TrailSync is currently free to use during the beta period. We may introduce paid features or subscriptions in the future. If we do:
- We will notify you in advance of any charges
- You can choose whether to subscribe to paid features
- Free features currently available may remain free or transition to paid tiers
- All fees are non-refundable unless required by law
Service Availability
We strive to keep TrailSync available and reliable, but we do not guarantee:
- Uninterrupted or error-free service
- That the Service will be available at all times
- That data will not be lost or corrupted
We may modify, suspend, or discontinue any part of the Service at any time with or without notice.
Termination
Your Rights
You may terminate your account at any time through the app settings. Upon termination:
- Your account and personal data will be deleted
- Trip data you created as an organizer will be deleted
- Your contributions to trips organized by others will remain
Our Rights
We may suspend or terminate your account if:
- You violate these Terms
- Your account is inactive for an extended period
- We must comply with legal requirements
- Continuing service would harm us or other users
Disclaimers and Limitation of Liability
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAILSYNC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Personal injury or property damage
- Lost profits or data loss
- Service interruptions
- Errors in route planning or navigation
- Actions or inactions of other users
- Reliance on information provided through the Service
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO TRAILSYNC IN THE PAST TWELVE MONTHS, OR $100, WHICHEVER IS GREATER.
Assumption of Risk
You acknowledge that outdoor activities carry inherent risks, including but not limited to:
- Injury, illness, or death
- Getting lost or stranded
- Exposure to weather and wildlife
- Equipment failure
YOU ASSUME ALL RISKS ASSOCIATED WITH OUTDOOR ACTIVITIES AND RELEASE TRAILSYNC FROM ANY LIABILITY.
Indemnification
You agree to indemnify, defend, and hold harmless TrailSync and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your User Content
- Your violation of any third-party rights
- Your outdoor activities planned using the Service
Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
Arbitration
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except you may assert claims in small claims court if they qualify.
Class Action Waiver
You agree that disputes will be resolved on an individual basis and not as part of a class action, consolidated action, or representative action.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Sending an email notification
- Displaying an in-app notification
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrailSync.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
Waiver
Our failure to enforce any right or provision in these Terms does not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
